UPON hearing counsel the Court made the following O R D E R:
1.) Heard senior counsels for the parties.
2.) Mr. Shekhar Naphade, senior counsel submits that he will place the records (made available with the Mediator) before this Court in a sealed cover for our perusal.
3.) We make it clear that pendency of this matter either before the Mediator or before this Court will not hamper with the investigation.
4.) I.A.No.13 Issue notice. Ms. Asha G. Nair, accepts notice. Learned counsel for the respondent sought time to file his response to this application. Time is granted.
5.) List all the applications along with the main matter on 8th August, 2012 for final disposal.

2.) वरिष्ठ सलाहकार Mr. Shekhar Naphade ने अपने विचार रखते हुए कहा की वह हमारे (कोर्ट के) संवीक्षण के लिए तमाम सारे साक्ष्यों / प्रमाणों (जो Mediator महोदय को भी उपलब्ध करवा दिया गया है) को मुहरबंद लिफ़ाफ़े में कोर्ट के समक्ष प्रस्तुत करेंगे.....
3.) हम (न्यायमंडल) यह स्पष्ट करते हैं की यह लंबित विचाराधीन मामला जो या तो Mediator महोदय के समक्ष है या न्यायालय के समक्ष, जांच-परीक्षण /अनुसंधान कार्य में किसी भी प्रकार का बाधा / अड़ंगा नहीं पैदा करेगा..........
4.) I.A.No.13 को अधिसूचना जारी किया जाता है, Ms. Asha G. Nair, ने उस अधिसूचना को स्वीकार किया, प्रतिवादी (I.A.No.13) के तरफ से वरिष्ट सलाहकार (Ms. Asha G. Nair) ने उस अधिसूचना के पक्ष में अपने आवेदन-पत्र के साथ अपनी जवाबदेही को न्यायालय में दाखिल करने के लिए समय की मांग की , न्यायालय के द्वारा समय प्रदान किया गया..........
5.) सभी आवेदन-पत्रों को मुख्य मुद्दे के साथ दिनांक 8 अगस्त 2012 को अंतिम निपटारे के लिए सूचिबद्ध किया जाता है.......

ReplyDeleteYesterday was a very important day for us as our matter was heard in Hon. Supreme Court and we got a favorable response in the interest of all our panelists . We are happy to share that honorable court gave a patient listening to our learned counsels and the other parties. The court heard our plea that we are not getting any cooperation from EOW is resolving the matter and disbursement of money which is already
lying with registrar of Supreme Court . This was also stated by Justice Lahoti in his report earlier. Based on our pleas ,the court directed EOW to hand over the data to the court on the next date fixed as 8th August and has kept for final disposal . This indeed is a great achievement as we are inching close to our victory. What normally takes years to achieve , we have been able to get on just 3-4 months . We will use this interim period to consolidate our position which should help in early resolution of our problems .
One point that continues to puzzle us that what is driving Navnit Khosla to pursue the matter in different forums despite AISPA members handling his claims and his affidavit in Mumbai High Court on withdrawal of his case. We fail to understand who is behind this and why he and his other friends now do not want disbursement to panelists to happen.
This order from Supreme Court with further reinforce the Mumbai High Court order that has restrained EOW from pursuing the investigation against the SAOL family ( Panelists , Distributors and employees ).
The next date of hearing in Mumbai High Court is on 28th June and till then there is total stay on proceedings by EOW, Mumbai .We would also like to share with you that we are taking legal opinion and pro actively working towards early resumption of our business in India .We understand that some misguided people will try to spread panic and create doubts in the minds of our people . So lets be on guard and not allow any such negativity to impact our progress. Also , do not give any of your personal details to any unauthorized person or on website which claims to be collecting data on behalf of the company . These are scamsters trying to take advantage of our position
Last in a similar everybody said 30th april hearing will be last and now same repeating
